Please read our Terms of Service carefully. By using our services, you agree to these terms.
Terms of Service between Eyma TEF (the “Service Provider”) and you (the “Client”) explaining rights, obligations, and responsibilities of both parties. “Eyma TEF”, “TEF”, “we” or “us” is a reference to the Service Provider, and “you” is a reference to the Client.
1 Service Overview
Eyma TEF provides the services to improve and polish the quality of an English-written document in terms of language and grammar, ensuring it error-free, amended and impactful. Our services are designed for authors, students, or businesspersons of English as a second language.
Eyma TEF will not write, create new content, or perform research for you. Our policy is to refrain ourselves from creating or changing the essential content of your document. Our editors respect the integrity of your ideas and the message you intend to convey. Thus, we prevent ourselves from intensively making alterations that might amend your document’s essential content.
We also do not analyze and check your document for plagiarism. We recommend you to perform this before we start working on your document.
2 Communications
By using our services, you agree to receive communications from us electronically. TEF will communicate with you by phone call, short message service (SMS), instant messaging (e.g. WhatsApp), and email. Unless otherwise specified, we do not guarantee the confidentiality of these electronic communications. You also agree that all agreements, disclosures, notices and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
3 Estimates and Quotes
Eyma TEF provides estimates and quotes on all work if a sample of the document is provided. An estimate is the approximate amount of time and price we believe it will take to complete the services required. A fixed quote can be made only if you provide us the final draft that is ready for editing and proofreading. If you are still working on the document, we can only provide you an estimate instead. An estimate will be updated to a quote when the final draft is received and evaluated by us.
You are obliged to advise us on any budget constraints before we commence the work on your document.
If you ask for changes to our service after we have started the work, the price will change accordingly and will be reflected in the updated estimates and quotes.
4 Copyright
Client submitting the document to Eyma TEF for service retain the copyright for their document, and TEF requires no other credit or acknowledgment for the work completed apart from the fees described in the quote. TEF does not claim any rights to such material by virtue of supplying its services, and will not use or disclose such material for any reason other than providing the services.
By submitting your document to TEF, you represent and warrant that you own or otherwise control all the rights to the document that you submit for service; that the document does not contain any content which violates any applicable local, national or international law regulation; that the document does not infringe, misappropriate or otherwise violate any copyright, trademark or other intellectual property rights, right of privacy, right of publicity or any other right of any entity or person; that the use of the document you supply does not violate this policy and will not cause injury to any person or entity; that the document is accurate; and that you will indemnify TEF for all claims resulting from any document and material you supply. TEF has the right to reject any document that violates these conditions and refuse activity related to such document. TEF takes no responsibility and assumes no liability for any document and material submitted by you or any third party.
5 Errors, Omissions, and Revision of Work
It is the client’s responsibility to ensure the accuracy of the information contained within the document and to check the finalized document carefully for accuracy in all respects. TEF is not liable for errors or omissions after you authorized and received the finished documents.
TEF provides advice on changes that you, your publisher, or other third parties may accept, reject, or further modify. Therefore, the content of any finished work is entirely the responsibility of the client or any other persons to whom the client’s licenses, delegates, or otherwise assigns control over his or her work. Comments provided to the client by TEF are provided for personal use only.
In the event that you are not satisfied with our service, we will promptly revise your document to your requirements in a limited amount of revision service stated on the estimate or quote, for no extra charge.
In the event of formal rejection or revision was issued by a publisher or institution where the document was sent to, a copy of rejection/revision statement should be forwarded to us.
6 Customers and Prices
TEF is committed to providing excellent editing and proofreading services at affordable prices. However, TEF is not obligated to refund the purchase price of any service under any circumstance unless explicitly agreed by TEF. Price, terms, and availability are subject to change without notice. All prices quoted are in Malaysian Ringgit (MYR) unless otherwise stated. TEF reserves the right to request payment prior to delivery of service, to refuse service, or to cancel orders, or to limit quantities at TEF’s sole discretion.
The purchase prices and invoices may be based on information that you provide to us, including the word count of the documents you are submitting for service. You represent and warrant that such information is accurate, and you agree to pay TEF any additional charges arising from any inaccuracy in such information within seven days of notification thereof. TEF is not obligated to verify the accuracy of such information but will refund to you any overpayment arising from inaccuracy therein.
7 Payment
Payment can be made by cash, bank/wire transfer, or credit card via PayPal, and you will pay all fees specified in quote issued that acknowledged by both party.
If any amount owing by you under this or any other agreement is overdue, we may accelerate your unpaid fee obligations under such agreements so that all such obligations become immediately due and payable, and suspend the finished work until such amounts are paid in full.
8 Privacy Policy
TEF holds the confidentiality of your intellectual property, the documents, and business data in high regard. We value your trust in us, and we are committed to protecting your privacy.
Any personal information recorded by TEF, such as your name, email, etc., will not be disclosed to any other party, except with those who work on our behalf to deliver you the required service, which again abides by our privacy policy. We ensure that we take necessary steps to protect your data against any kind of misuse and loss.
We never store any information about the credit/debit card that you use for conducting transactions with us. All electronic transactions are carried out through secure payment methods such as PayPal.
9 Limitation of Liability
TEF attempts to be as reliable and accurate as possible. However, TEF does not warrant that its services performed are complete, accurate, reliable, error-free, or current.
While we endeavor to ensure that any files originating from us are free of known computer viruses, we make no warranty or guarantee that files are virus-free, and we are not able to provide any assurances concerning email or attachments that may have originated with third parties. Therefore, all recipients are cautioned to check all email, attachments, and other computer files before accessing them, and the recipient assumes any and all risk of virus contamination.
10 Service Termination
In the event you are dissatisfied with the quality of the work, you agree to inform us of this dissatisfaction and allow us a reasonable chance to amend the issue. If after amendment, you remain dissatisfied with the quality of the work, you may choose to terminate the on-going work. In such case, if you have paid for work not yet performed, we will refund the outstanding difference.
11 Contract and Agreement
Eyma TEF organizes the administrative and managerial tasks of its editors, but the commitment made between the client and the editors is an individual-employment basis with a type of contract that binds the two parties only. Thus, client hires TEF, and the assigned editors agree to work for client under this Term of Service hereby agreed upon by the parties.
12 Others
The aforementioned terms of service constitute the complete and exclusive statement of the mutual understanding of the parties and supersede and cancel all previous written and oral agreements and communications relating to the subject-matter hereof. If any provision of this agreement shall be unlawful, void, or for any reason is unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
